Welcome to Hyundai for Hire! This Privacy Notice (this“Privacy Notice” or“Notice”) explains how Hyundai Auto Canada Corp. (“Hyundai Canada”) and The Bank of Nova Scotia (“Scotiabank”, and collectively“we”, “us”, “our”, etc.) together, collect, use, disclose and otherwise process your personal information with respect to certain aspects of Hyundai for Hire. This Privacy Notice applies when you visit and interact with www.hyundaiforhire.com (the “Platform”), specifically when you use the online features and services, such as creating an account and reserving your Hyundai vehicle (“Services”), as well as when you communicate with us online.

PLEASE NOTE THAT IF YOU RESERVE A VEHICLE FROM HYUNDAI FOR HIRE, YOUR PERSONAL INFORMATION WILL ALSO BE GOVERNED BY THE PRIVACY PRACTICES OF THE HYUNDAI DEALER THAT YOU RENT FROM. PLEASE SPEAK WITH YOUR HYUNDAI DEALER TO LEARN MORE ABOUT THEIR PRIVACY PRACTICES.

By using Hyundai for Hire, this Platform and our Services, you agree to the practices outlined in this Privacy Notice. If you do not agree, you should not interact with our Platform or use any of the Services, or otherwise provide Scotiabank or Hyundai Canada with your personal information.

  1. How we collect personal information

    In most cases, we collect your personal information when it is directly provided to us (e.g., when you create a Hyundai for Hire account or request a reservation). We also collect information through calls, emails or chats with us online. Further, like many websites and technologies, we automatically collect technical data when you visit and interact with the Platform and use our Services.

  2. the personal information we collect and for what purpose

    We collect a variety of information including your contact information, payment details, reservation preferences and communications you have with Hyundai Canada or Scotiabank. The precise types of information that is collected will depend on your interaction with Hyundai for Hire, the Platform or the Services.

    Creating an account: When you create an online account with us, we will collect your name, phone number, email address and password. We use this information to create and manage your Hyundai for Hire account. An account is required in order to reserve a vehicle.

    Reserving a vehicle: In order to reserve a vehicle, we will collect your name, date of birth, driver’s license information (including issuing country and province, number and expiry date), your responses to driving history questions (including how long you have had a valid Class G license), your address as well as your payment information (including cardholder name, credit card number, expiry date and CCV code). We will also collect your reservation details, including the make and model of the Hyundai vehicle, the pick up and return dates and times, and your selected Hyundai dealer.

    Another driver: When reserving a vehicle, you have the option to add another driver to the reservation. In this case, we will collect much of the same information as described above, including their name, contact details, driver’s license information and driving history. By providing this information, you acknowledge that it is your responsibility to ensure that the person you have provided personal information about is aware that you have done so, and they understand and accept how Hyundai Canada and Scotiabank use their information.

    Refer-a-friend: Our Platform provides you the option of referring Hyundai for Hire to a family member or friend. You can do so by email or via certain social media platforms. We will collect basic details, such as the referred name and email address. We collect this information to provide the refer-a-friend functionality. We will not use the person’s information further, unless they reach out to us directly.

    Communications: If you contact us via the Platform or by phone, we will collect the information communicated during this contact. We use this information to respond to your inquiry, question, complaint, etc. We may review chats and record calls for quality control purposes, to enforce our legal rights, for training or for similar purposes. In addition, we may use your name and contact details to get in touch with you about your reservation or to provide you with other important details related to our business relationship with you. s.

    Marketing: We may collect your name and email address to send you promotional and other marketing materials that we think you will enjoy. If you opt-in, we will collect your name, email address and postal code to send you promotional emails from Hyundai for Hire, Hyundai Canada or Scotiabank. See "Your Choices" to learn how to opt-out of this service.

    Providing, managing and improving our Services: Hyundai Canada and Scotiabank collect and use your personal information for the overall provision, management and improvement of Hyundai for Hire, including this Platform and related Services. We use the information to administer the reservation, calculate any fees, diagnose problems, improve our operations and performance, execute necessary checks (including driving and credit history), to better understand how customers use and enjoy Hyundai vehicles, as well as research and develop new products and services.

    Demographic Data: Hyundai Canada and Scotiabank may also collect and use demographic information such as your age, gender, habits or preferences, interests in vehicles, reservation location, whether any special needs or equipment was requested, where and when you returned the vehicle, customer service inquiries or complaints, payment arrangements, gas consumption, mileage, accident history and other information related to the vehicle. Hyundai Canada and Scotiabank use this data to administer your rental and also to better understand our customers and provide you with relevant offers. We collect, use and otherwise process this data in a way that no longer identifies you. See "Data Analytics" to learn more.

    Vehicle Data: Some vehicles come equipped with a global positioning system (GPS) or similar type-tracking device that may also collect information about the vehicle. Further, some of our connected vehicles are equipped with devices that may monitor and store data on the vehicle’s condition, performance and operation, track fuel consumption, distance travelled, location and other information.     Automatic Website Data: Like many websites and online platforms, we use cookies and other technologies to automatically collect certain data about how visitors use and interact with our Platform and our Service. See “Online Website Data" to learn more.

    Legal Rights and Compliance: We may use certain personal information to enforce our legal rights, including recovering lost, stolen or towed rented vehicles, or to defend, protect or enforce our rights or to prevent fraud. Lastly, we may use personal information to otherwise comply with applicable law.

  3. Online Platform data

    Like many sites, this Platform uses cookies, etags, web beacons and other similar technologies to automatically collect certain technical data from your computer or mobile device. This section tells you more about what technical information we collect and why we collect it.

    IP Addresses: We may collect your IP address when you visit the Platform to help us diagnose problems, for system administration, to report aggregated information to our business partners, and to audit the use of our Platform. We do not normally link IP addresses to anything personally identifiable. In select circumstances, we may use IP addresses to help us identify you when we feel it is necessary to enforce compliance with our Platform terms of use.

    Cookies & other similar technologies: We use cookies, scripts, pixel tags, etags, web beacons and other similar technologies. Depending on the type of cookie or technology used, these tools may be necessary for the Platform to function, improve performance or assist us in recognizing you, such as when you log into your Hyundai for Hire account. We collect this data to help us analyze our Platform flow, performance, content structure, better reflect visitor preferences, prepopulate information so that you do not have to enter it over and over again as well as track usage. You can control your cookies and other technology preferences by going to your browser settings and tools.

  4. Data Analytics

    Business analytics involves the analysis of data to understand trends and insights about how individuals use our Platform and our Services. Aggregated data means data that is combined so that you are no longer identifiable. We use analytics and aggregated data to improve our business.

    Hyundai Canada and Scotiabank anonymize personal information and technical data in a manner that can no longer identify you individually. We use aggregate data to help us understand how customers, viewers and other individuals use and interact with Hyundai for Hire, the Platform and Services, as well Hyundai Canada and Scotiabank related products and services. We also use this data to improve our products, services and brands, generate reports and market Hyundai for Hire and our related products and services.

    We may also provide the insights we learn from business analytics and aggregated information to our partners.

  5. Vehicle data

    Your Hyundai vehicle may contain an event data recorder which can collect and store information about your vehicle and its occupants immediately before and during a collision or near collision event. This information may include information on how various systems in the Hyundai vehicle were operating, including parameters such as how far the driver was depressing the accelerator or brake pedal, vehicle speed, steering, the use of the front seat belts, airbag deployment data as well as diagnostic information.

    Some vehicles you rent from Hyundai for Hire may be equipped with devices that may monitor and store data on the vehicle’s condition, performance and operation, track fuel consumption, distance travelled, location and other information. You acknowledge that any such device will always track this information, even when other services or other media in the Vehicle are turned off. You expressly authorize the transmission of this information to us, our third-party service providers, the vehicle owner and/or the vehicle manufacturer.

  6. Children

    We do not knowingly collect personal information from children. If you think we have received personal information from children under the age of 13, please contact us immediately.

    Hyundai for Hire, including this Platform and our Services, is only offered to individuals 25 years and older. If you are under 25 years old and provide us personal information, Hyundai Canada and Scotiabank reserve the right to delete or aggregate that personal information.

  7. Sharing and disclosure of personal information

    In certain circumstances, Scotiabank and Hyundai Canada will share your personal information with third parties.

    Hyundai Dealers: We transfer relevant personal information to the Hyundai dealer you have selected in your reservation. The information we transfer includes your account information, reservation information and if applicable, the additional driver information. We must transfer this information to your selected dealer in order to prepare your reservation. If you have a query about your reservation, we may contact the Hyundai dealer and request they handle your request. In cases of reservation-related disputes, we may provide the Hyundai dealer with information about the reservation process as required to address the dispute.

    Hyundai Canada and Scotiabank affiliates: In order to support the use of Hyundai for Hire, this Platform and the Services, we may share your personal information with subsidiaries and affiliates of both Hyundai Canada and Scotiabank. This information may include your account information, your reservation history, communication information and demographic data.

    Service providers: Scotiabank and Hyundai Canada use third party service providers to support us in providing Hyundai for Hire. These service providers provide support services such as customer support, market research, data hosting, fraud detection and prevention services, background checks and payment services. In certain circumstances, we may transfer the relevant information to third party service providers that assist us in processing payments and refunds, handle debt collection, resolve toll, traffic or parking violations, or as otherwise needed to provide the services you have requested. The information transferred to these service providers is limited to what is necessary for them to provider their service. For example, for those that opt-in to receive promotional emails, we will transfer names and email addresses to our marketing agency that will assist us in our electronic marketing campaigns.

    Competent Authorities: We share personal information with government, regulatory and law enforcement agencies in the following circumstances: to verify your driver’s license and ensure you meet our approved driver criteria; as requested by these agencies if the disclosure is required or permitted by law; in order to take action regarding illegal activities or violations of terms of service; if we have a good faith belief that there is an emergency that poses a threat to the safety of you or another person; and / or as otherwise required or permitted by law.

    We may also transfer or assign your personal information to third parties as a result of, or in connection with a sale, merger, consolidation, change in control, transfer of assets, bankruptcy, reorganization, or liquidation.

  8. safeguarding personal information

    The security of your personal information is important to us. We take reasonable steps to make sure your information is protected from unauthorized use, access, disclosure, alteration, destruction or loss. We use security procedures and technical and physical restrictions for accessing and using the personal information on our services. Only authorized personnel are permitted to access personal data in the course of their work. For more sensitive personal information, we use firewalls and Secure Socket Layer (SSL) encryption.

    We will not ask for sensitive information, such as your credit card number, passcode, account number or pin number, in an e-mail, text or on a website or platform not operated by Hyundai Canada, Scotiabank or our affiliates. If you do receive a suspicious request, do not provide your information.

    If we use third party service providers to assist in us in data processing, we use contractual or similar means to ensure third parties safeguard your information as well as restrict their use of information.

    You are responsible for keeping your account username and password safe and secure. Do not share those with anyone. If there is an unauthorized use or any other breach of security involving your information, you must notify us as soon as possible. We are not responsible or liable for any loss or damage if your account password is stolen or used inappropriately.

  9. Storage and retention

    For the most part, your personal information will be stored in Canada. As part of our normal business operations, we may be required to transfer and store your information in the United States. As such, your personal information may be subject to the laws of the United States. Further, our third party service providers may be located in the United States, in which case we use contractual or similar means to ensure that your personal information is safeguarded.

    We will retain your personal information for as long as we deem necessary to enable you to use Hyundai for Hire and our Services, including maintaining your online account. Our retention practices may change to allow us to comply with applicable laws, to resolve disputes or as otherwise necessary to allow Hyundai Canada and Scotiabank to conduct business with you, including to detect and prevent fraud or other illegal activities. All personal information we retain will be subject to internal, established retention policies and procedures.

  10. social media and third-party links

    The Platform may link to third party websites or include social media features, such as the Facebook Like button. These features may collect your IP address, which page you are visiting on our Platform, and may set a cookie so that the Like button feature works properly. Third party websites links and social media features and platforms are governed by the privacy notices of that website or social media platform, and not Hyundai for Hire’s Privacy Notice. We encourage you to review the privacy notices of any website or social media platform you visit.

  11. Your choices

    You have choices with respect to your personal information.

    Access, update and correct your Hyundai for Hire information: You can update some of your information by logging into your Hyundai for Hire account and editing your profile. You play an active role in helping Scotiabank and Hyundai Canada to keep your information up to date and accurate.     We may take steps to verify your identity before granting access to your information or making corrections. Sometimes, we may not be able to provide you access or make the corrections, and will let you know how you can challenge our decision.

    Opt-out of marketing: If you opted-in to receive emails, you may unsubscribe at any time. To opt-out click the “unsubscribe” function at the bottom of an email you receive. If you opt-out from receiving marketing emails from Hyundai Canada for Hyundai for Hire, this will not affect your email preferences for general Hyundai Canada marketing. In order to opt-out from receiving general Hyundai Canada marketing emails, you must click the “unsubscribe” function at the bottom of a general Hyundai Canada marketing email. If you opted in to receive emails from both Scotiabank and Hyundai Canada, you must unsubscribe from both organizations, in order to stop receiving marketing emails from both of us.

  13. Changes

    Hyundai Canada and Scotiabank reserve the right to modify this Privacy Notice at any time at our sole discretion, without notice. Changes to this Privacy Notice will be effective immediately on posting to our Platform. You agree to review this Privacy Notice on each visit to the Platform to inform yourself of any such modifications.
